How do I know if I’m eligible to file a small claims document?

In California, small claims have a limit of $7,500. Damages that exceed $7,500 should be filed in the Civil Division.

Can you file the Small Claims documents for me?

How much time do you need to serve small claims documents?

Due to the deadlines that the court allows for service of process, we require:

1. In-County services – at least 35 days prior to the hearing date.
2. Out of County – at least 40 days prior to the hearing date

Do you file the proof of service?

As a courtesy for small claims cases, we send out (1) original to the court for filing and (1) original to the address you specified in your instruction letter.

So what do I do after this?

Ten days prior to the hearing date, contact the court clerk to make sure that the proof of service is filed. After that, just prepare for your hearing.
